4.3 Legal Basis for Processing
For technical and communication purposes: Processing is necessary to perform the contract concluded with the User (Article 6(1)(b) GDPR) – direct operation of the AI Generator.
For marketing purposes (Newsletter): Processing is carried out on the basis of voluntary, conscious, specific, and unambiguous consent expressed by the User (Article 6(1)(a) GDPR).
4.4 Consent for Newsletter and Mailing List
Consent for the Newsletter is entirely voluntary and separate from using the AI Generator.
Checking the field confirming the desire to receive the Newsletter is optional.
This field is not checked by default.
The User expresses consent by actively checking a separate checkbox.
Each time, the User must express conscious and voluntary consent.
Newsletter consent contains the following information:
- The data controller is PixelDuetWeb civil partnership
- Data will be processed for sending commercial information (Newsletter) and commercial messages
- The User has the right to withdraw consent at any time
- Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal
